The assessor advised that Miss Kelly be held against her will. Miss Kelly did not want to go to a unit and approached her psychiatrist, Dr. Ramanathan Elayaperumal. He was a Consultant Psychiatrist within the Home Treatment Team at Essex Partnership NHS Foundation Trust.

In response to this recommendation, the Home Treatment Team conducted a comprehensive evaluation of Miss Kelly's state of mind and functioning. The evaluation included an in-depth medical history and physical examination. It also included a thorough assessment of family and psychological therapy as well as a psychiatric diagnostic interview.

According to the report the report states that Miss Kelly was afflicted by multiple mental health issues, including borderline personality disorder, bulimia-nervosa, and anorexia nervosa. She also had a history of drug misuse and had experienced domestic violence. Stress, anxiety and depression exacerbated her symptoms. She was also diagnosed with bipolar affective disorder as well as schizophrenia-related disorder.

Elayaperumal claims that Medtronic intentionally did not treat him fairly due to his race and national origin. He argues that his low performance review in June 2000 as well as the inability to provide him with specific project assignments were influenced by racism or national animus. However there is no evidence to suggest that Medtronic's decisions were based on those factors. Furthermore, Elayaperumal's less-than-perfect performance review did not result in a reduction in his salary or benefits, or even his the responsibilities he had.
